You have probably seen the headlines: "Spain bans vaping on beaches and terraces in 2026." Here is the part those headlines leave out. That ban is a bill that has not passed yet. As things stand, it is not the law, and nobody is fining tourists for vaping on a terrace. Spain is genuinely tightening its rules, and the direction of travel is clear, but there is a big difference between what is coming and what is enforced today.

Here is exactly where Spain stands, checked against the actual state of the legislation rather than the scare stories.

Is vaping legal in Spain?

Yes. Vaping is legal in Spain for adults. You can bring your own device and liquid, use them, and buy more while you are there. There is no ban on tourists carrying a personal vape, and Spain is an EU country, so bringing your own kit over from the UK is straightforward.

What is changing is where you can vape and, in time, what you can buy. Both of those are worth understanding before you travel, because the rules in 2027 will not be the rules you might remember from a trip a couple of years ago.

Vaping on terraces, beaches and in other outdoor spaces. The reform would extend smoke-free and vape-free zones to bar and restaurant terraces, public transport shelters, university campuses, beaches, playgrounds and the entrances to public buildings. As of now this is proposed, not enforced. Treat it as the near future rather than today's rule.

A ban on disposable vapes. A separate bill to ban single-use disposables has been submitted to the Spanish Congress and is expected to be voted on later in 2026, with a stock clearance period after that. The practical effect is that disposables are likely to disappear from Spanish shelves around 2027. They are still on sale for now.

Sales moving to tobacconists. Spain is also moving vape sales towards its licensed tobacconists, the estancos, rather than every corner shop and vape store. This is being phased in, so where you can buy a vape in Spain is going to narrow over the next year or two.

None of this stops you vaping in Spain today. It just means the Spain you vape in next summer may look different, and it is worth travelling with your own kit.

Where you can and cannot vape right now

The firm rule that is already enforced is simple: if you cannot smoke there, do not vape there. Vaping is banned in enclosed public places, so no vaping inside bars, cafes, restaurants, shops, workplaces or on public transport. Spain also already restricts vaping in some sensitive outdoor spots such as school and hospital grounds and children's play areas.

Terraces, beaches and open streets are, for now, not covered by a national ban, but two things are worth remembering. Individual towns and regions can set stricter local rules, and the national terrace and beach ban is coming. The safe and courteous approach is to treat busy terraces and beaches the way you soon will have to anyway: step to one side, keep clouds away from other people, and follow any local signs.

Can you buy vapes in Spain?

It is cheaper, it is future-proof, and it means a good holiday never hinges on finding an open estanco.

Spain has a relaxed reputation around cannabis because of its private members' clubs, but that does not extend to carrying a THC vape through an airport or around the streets, which is treated as a drug matter. Keep it simple: bring nicotine, leave anything cannabis related at home.
