How to Spot a Fake Vape in the UK

Most fake vapes give themselves away in seconds: they hold more than 2ml with nothing to refill them, claim more than 20mg of nicotine, or are sold as single-use which has been illegal in the UK since 1 June 2025. This is a guide of the full set of fake vape checks, from the packaging to the price arithmetic, plus what changes when duty stamps arrive in April 2027.

The legal limits every real vape obeys

• 2ml maximum in any pod or tank
• 20mg per ml maximum nicotine strength
• 10ml maximum bottle size for nicotine-containing e-liquid
• Notified to the MHRA: every legal product appears on the MHRA's public search before it can be sold, and carries its own ECID identifier

The single-use giveaway

Single-use vapes have been banned in the UK since 1 June 2025, so any sealed vape sold to be thrown away after use is illegal stock, whatever the shop calls it. Our disposable ban guide covers what changed on the day.

Legal high-capacity vapes account for their liquid in millilitres you can point at: a rechargeable kit with a 2ml pod, refilled from a bottle or a refill container sold alongside it, such as the PIXL 8000 vape kit's 2ml pod paired with a 10ml refill container. A sealed throwaway body claiming thousands of puffs with nothing to refill it cannot be legal, because the liquid has to live somewhere.

The packaging checks

• The nicotine warning: "This product contains nicotine which is a highly addictive substance" must cover roughly a third of the front and back. Missing or shrunken warnings are the most common giveaway that a vape is fake.
• Ingredients, batch number and manufacturer details: legal packaging carries all three
• The brand security code: Lost Mary, Elf Bar and the other big brands print an authenticity code on the box that you can check on the brand's own site

Does a cheap price mean fake?

No, and that especially matters through the next year. Kits from £2.49 and nic salts from £1.99 are normal prices in a legal shop, and shops can sell stock bought before the vape tax at pre-duty prices until 31 March 2027. Cheap is not a red flag on its own.

The arithmetic becomes a test in two steps. From 1 October 2026 new stock carries 22p per millilitre of duty, so as duty-paid stock takes over the shelves, a price below the duty itself becomes impossible for legal liquid.

How to check a Lost Mary is real

Fake Lost Marys are among the most searched-for counterfeits in the UK, and the checks to spot a fake are the ones above - with one addition. Genuine boxes carry a holographic label and a QR code on the side, and the security code under it can be checked out on Lost Mary's official verification page in seconds. A fake usually fails the basics anyway, through a strength above 20mg, a sealed body with no refill system, or a missing nicotine warning.

Where fakes are sold, and where they are not

Illegal vapes move through car boot sales, social media vendors and under-the-counter corner shops - not through registered vape retailers with age checks and MHRA-notified stock. The scale of that market is its own story, and our piece on the UK's illegal vape epidemic tells it with the numbers.

The practical rule is short: buy from a shop that can tell you exactly what is in the product and where it came from. If the deal only exists in a carrier bag, leave it there.

Vaping is substantially less harmful than smoking but it is not risk-free, and it is intended for adult smokers and existing vapers. If you do not smoke, do not vape.
